Construction coverage research

Workers’ compensation by state

Construction coverage triggers, owner treatment, subcontractor rules, and public lookup resources for 51 jurisdictions. Read the conditions and verification gaps together.

Check workers’ compensation by state before hiring

Find the work jurisdiction, then read its construction trigger, owner rules, subcontractor rule, and notes together. This table covers 51 jurisdictions. Headcount can be only one condition; payroll, work duration, owner status, and the contracting relationship can also matter.

North Carolina illustrates the distinction. Its Industrial Commission guidance describes the three-employee trigger and exceptions. Separate liability can arise for an uninsured subcontractor’s employee under G.S. 97-19. Read the statute’s conditions rather than treating a small crew as an exemption.

A sole proprietor’s exclusion differs from a business’s duty to cover employees. The table keeps sole-proprietor and LLC-member treatment in separate columns. A blank records an unresolved field, not permission to proceed without coverage.

Public lookup links identify research tools. They do not certify an employer’s policy or decide coverage on a disputed injury date. Match the employer, work date, and contracting arrangement to evidence confirmed with the employer or insurer.

Use the subcontractor workers’ compensation guide to prepare that request. North Carolina’s employment definitions, exceptions, and certificate statute raise separate questions. Ask the Commission, insurer, or qualified adviser which facts control your case.

Key findings from the recorded data

Keep licensing and coverage checks separate. The contractor licensing by state research identifies authorities to ask about work credentials.

How to use the table

Find the work jurisdiction. Read the complete construction trigger, both owner columns, the subcontractor rule, and notes together. Open the cited agency or statutory text before applying an exception.

Use the lookup description to understand the linked resource’s scope. Confirm the legal employer name, relevant dates, and coverage with the employer or insurer. No employer-specific lookup query was submitted for this research. Do not turn a blank into “not required” or “no liability.”

Method and caveats

The October 14, 2026 research used state agencies, statutes, agency publications, and linked coverage services. Some evidence came from indexed primary-source extracts when direct retrieval was unavailable. The source references contain 151 reference entries at 141 unique URLs. Semicolon-separated citation IDs align with the pipe-separated row URLs in order.

All 2026 amendments and effective dates were not reconciled. Arizona and Oregon sources flag timing issues. Mississippi’s threshold evidence is an older brochure. New Jersey’s subcontractor evidence includes a 2020 compilation. Colorado evidence includes indexed agency development/test pages, and its lookup fields remain blank.

Owner exclusions, independent-contractor status, statutory employment, self-insurance, and public-project terms can require further review. Lookup interfaces were not tested through live employer searches. A coverage certificate or database result does not decide an individual claim.

Where Cercha fits

Cercha provides profiles, project portfolios, endorsements, and direct messages to help builders and trades begin working conversations. Use Messages to ask the employer for current coverage information. Profiles show credential badges with a disclosure: coverage information may not reflect changes reported within the last 30 days. Verify directly with the employer or insurer. For the Raleigh-Durham Triangle beta, ask about the beta.
